Charges to be filed against Fontana woman selling underage puppies online

FONTANA -- A litter Pit Bull puppies and their mother are resting comfortably in an Oregon foster home after Fontana Animal Services officers busted their owner who was attempting to sell them illegally online.

Charges will be filed next week against a Fontana woman who was caught selling the underage puppies on Craigslist, due to the help of an out of state animal rescuer.

It is a misdemeanor in California to sell puppies under 8 weeks old. The puppies were only a few days old at the time the ad was posted online.

"The puppies should stay with their mom and this law was created to protect the health and safety of the puppies," said Fontana Animal Service Officer Jamie Simmons. "If by giving away or selling under age puppies increases the mortality rate for those puppies. "

Simmons was contacted by numerous animal activists, including out of state and even out of the country who saw the advertisement.

Amanda Giese, founder of Panda Paws Rescue in Vancouver Washington, was alerted to a listing on Craigslist for the sale of the then three-day old puppies.

After conducting an investigation of her own, she contacted the Fontana Police Department.

"Once we had enough evidence I contacted the Fontana Police Department and Jamie Simmons in particular and they set up an operation to bring the woman down," she said.

Fontana Animal Servicesofficers conducted an undercover operation to prove the woman was selling the dogs under age before going in and removing the dogs from her care.
"Last Tuesday she sold a 6-day-old puppy to one of our undercover officers after knowing what she was doing was illegal. I talked to her on the phone and told her this was illegal and more importantly it was not safe."

The puppies, named Blueberry and her blueberry muffins, and their mother will be cared for in Oregon until they are about 12 weeks old. They will then be sent to Giese and Panda Paws, a non-profit that rescues special needs and abused dogs.

Puppies under 8 weeks old still require nutrients only obtained from their mother's milk.

It also causes unnecessary suffering to the mother when she is separated from her litter, Simmons said.

Checking online ads for the illegal sale of underage puppies is routine for the animal services officers, Simmons said.

"Often times by the time the online ad is posted, by the time we catch up the puppies are more often gone or sold or we just can't find the seller, so we really do have to rely on the assistance from the public to alert us of these," Simmons said.

Giese said she has been and is involved with several other cases similar to the one in Fontana.

"This is really common," she said. "We've had one in Washington this week. We took care of one in Idaho last week. Since the media got a hold of this story my email has been blowing up. "

Giese said she encourages anyone who sees any suspicious craigslist listings for animals to report it.

"I really want to encourage people to step up and call the police, call authorities and report it," she said. "It's better to say something and be wrong and say nothing at all and be right. "

Simmons said they like to be proactive in educating the public of these laws because some people do not know it is illegal to sell or give away underage dogs.

Simmons also encourages people to adopt from their local shelter, where dogs are facing euthanasia.

Dogs adopted from the shelter are fully vaccinated, get a clean bill of health and are spayed and neutered.

Fontana Animal Services picked up 14 abandoned dogs and puppies in various parts of the city just yesterday, she said.

"If you're looking for a designer breed the shelter has them. If they're mixed, even better. Every dog deserves a chance at life," Simmons said. "You don't have to go and buy from somebody on the street corner cash only. "

If the government can't tax it. You can't sell it.
